Terms and Conditions – Vacation at the Poenenhof

We do our very best to ensure that you have a relaxing vacation at the Derksen family’s Poenenhof. To avoid any misunderstandings, clear agreements are necessary. Therefore, please read the following terms and conditions for the “Vacation at the Poenenhof” carefully.

The guest’s/tenant’s reservation is subject to the terms and conditions agreed upon between the guest and the Poenenhof. If no such agreements exist or if they are incomplete, the offers on this website are based on the following terms and conditions:

Guest/Renter’s Reservation:

Reservations may only be made in writing and are considered binding on both parties, at which point the rental agreement is concluded. The guest/tenant is liable for all vacation rooms, including any booked services (lodging, meals), that were booked under his or her name. Changes or cancellations must be made in writing. (See below for cancellation policy.)

Booking with Poenenhof:

The lodging agreement is deemed to have been concluded when the landlord confirms in writing, via a booking confirmation, that the vacation rooms are available. The agreement is thus deemed to have been concluded and is binding.

Services:

The features shown in the media are for illustrative purposes only. Actual features may vary. Our services do not include insurance.

Day visitors:

Day visitors and guests are not permitted.

Arrival and Departure:

As stated in your booking confirmation. Check-in and check-out outside of regular hours are permitted only by written agreement.

During the holidays, arrivals are only possible on Fridays, Sundays, and Wednesdays.

Early Departure:

In the event of an early departure, there is no entitlement to a refund of the rental fee.

Offers and Prices:

All offers are subject to change and non-binding. Prices are adjusted annually on January 1, as you can see from the prices listed on our website.

Terms of Payment:

Upon receipt of our detailed booking confirmation, a 50% deposit of the trip price is due within seven days. The balance must be paid no later than six weeks before arrival. For school trips, the deposit is due nine months before arrival or as otherwise agreed, and the balance is due six weeks before arrival. If a booking is made on short notice—that is, within six weeks of arrival—the full amount must be paid within seven days of booking.

Cancellation Policy:

Unfortunately, as the property owner, we cannot bear the sole risk of a possible cancellation. In the case of last-minute cancellations, it is sometimes impossible to find replacement guests. The property owner is encouraged, whenever possible, to rebook unused vacation rooms to avoid financial losses. If it is not possible to rent out the vacation apartments during the canceled period, the tenant is responsible for paying for that period. The tenant may withdraw from the contract at any time by submitting a notice of withdrawal or cancellation to the Derksen family’s Poenenhof. The withdrawal must be submitted in writing. In the event of cancellation of the vacation rental (total amount for lodging, meals, linen packages, and pets), the following rules apply:

-For school trips, you may cancel free of charge up to 365 days before the start of the trip; starting eight months before the start of the trip, 60% of the total amount will be charged. For cancellations by individual participants in school trips, weekend getaways, and other types of stays, the following cancellation policies apply:
• Cancellations are free of charge up to 5 months before arrival.
• For cancellations made between 5 and 3 months before arrival, 30% of the trip price will be charged.
• If the cancellation is made between 3 months and 1 month before arrival, a cancellation fee of 40% of the trip price will be charged.
• For cancellations made between 1 month and 1 week before arrival, the cancellation fee is 80% of the trip price.
• No refunds will be issued for individual participants who cancel their participation in a school trip within the last week before arrival.

If the booked trip cannot take place due to a general, official order (travel ban/ban on lodging), we will cancel the affected reservations free of charge.

House Rules and Duty of Care:

The tenant must comply with the house rules. The premises and furnishings must be treated with care. The tenant/guest is responsible for compensating the landlord for any damage caused through negligence, to the extent that the tenant, their traveling companions, or guests are at fault or otherwise responsible for such damage. However, this does not refer to minor incidents, such as a broken glass. Any damage or defects that occur during the rental period and are noticed at the start of the stay must be reported to the landlord immediately. The landlord must remedy the situation as soon as possible.

Termination:

The landlord is entitled to terminate this agreement with immediate effect in the event of misuse of the vacation rental or other serious breaches of the agreement.

The Landlord:

is not liable for the loss of or damage to any items brought onto the premises, including cars.

Smoking:

Smoking is prohibited throughout the entire building, as well as in the game rooms. In the event of a violation, the landlord is entitled to issue an invoice for the costs of removing odors or repairing any damage caused. Outside the buildings, guests must use the ashtrays provided.

At your own risk:

Use of the playground equipment, bounce houses/trampolines, slides, go-karts, and all other play equipment, as well as the entire yard, is at your own risk. Visiting the petting zoo and interacting with the animals is also always at your own risk. We expressly emphasize the importance of treating the animals properly. Any misuse will result in the immediate termination of any contract.

House Rules:

Under certain circumstances (which are rare, such as a malfunctioning heater, a burst pipe, or an imminent danger), it may be necessary for the landlord to enter the vacation rental without the guest’s knowledge.

Subject to change:

Parts of these Terms and Conditions may be amended or supplemented due to current case law, orders from the highest courts, or changes in market conditions. Poenenhof will notify the customer of such changes by email upon request.
